Terms of Service

By creating an account on CulchieOS or using any part of the platform (including the website culchieos.ie and any associated mobile applications), you agree to be bound by these Terms of Service.

If you are using CulchieOS on behalf of a business (including a farm partnership or limited company), you represent that you have authority to bind that business to these terms.

If you do not agree to these terms, do not use CulchieOS.

These terms are governed by the laws of the Republic of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.

CulchieOS is a farm management platform operated by Dun na Dev Ltd. (the "Company"). The platform provides tools for livestock management, land mapping, crop planning, staff management, financial record keeping, grant tracking and related farm management functions.

We reserve the right to add, modify or remove features at any time. Where significant features are removed, we will provide reasonable notice.

We do not guarantee uninterrupted or error-free access to the platform. We will endeavour to maintain at least 99% uptime, measured monthly.

To use CulchieOS you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials.

You must be at least 18 years of age to create an account.

You agree to provide accurate, current and complete information during registration and to keep your account information updated.

You are responsible for all activity that occurs under your account. If you believe your account has been compromised, you must notify us immediately at info@culchieos.com.

We reserve the right to suspend or terminate accounts that violate these terms.

New accounts receive a 30-day free trial with full access to all Professional plan features. No credit card is required to start a trial.

At the end of your free trial, you must select a subscription plan to continue using CulchieOS. If you do not select a plan, your account will be moved to a limited read-only mode.

Subscription fees are charged in advance on a monthly or annual basis. All prices are shown excluding VAT. Irish VAT at the applicable rate will be added where required by law.

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for the unused portion of a billing period except where required by law.

You agree not to use CulchieOS to:

— Upload, post or transmit any content that is unlawful, harmful, threatening, abusive, defamatory or otherwise objectionable.

— Attempt to gain unauthorised access to any part of the platform, other users' accounts or the underlying infrastructure.

— Use the platform to transmit spam, unsolicited messages or any form of commercial communication not permitted by these terms.

— Reverse engineer, decompile or disassemble any part of the platform.

— Use automated tools to scrape, crawl or extract data from the platform.

— Impersonate another person or entity, or falsely represent your affiliation with any person or entity.

We reserve the right to suspend or terminate your access if you breach any of these provisions.

You retain ownership of all data you upload to or create within CulchieOS (your "Farm Data"), including livestock records, financial records, staff records and any other content you create.

By uploading Farm Data, you grant Dun na Dev Ltd. a limited, non-exclusive, royalty-free licence to store, process and transmit that data solely as necessary to provide the CulchieOS service.

We will not use your Farm Data for any purpose other than operating and improving the service, as described in our Privacy Policy.

You can export your Farm Data at any time using the Export module. If you terminate your account, you should export your data before doing so. We will delete your data within 30 days of account termination, subject to any legal retention obligations.

The Culchie Club marketplace and jobs board allow users to post listings and interact with other users. CulchieOS acts as a platform for these interactions only and is not a party to any transaction between users.

You are solely responsible for the accuracy and legality of any listings you post. By posting a listing, you represent that you have the right to sell, advertise or offer the item or service described.

CulchieOS does not verify the accuracy of listings, the identity of users or the quality of goods or services advertised. All transactions are between the buyer and seller. CulchieOS accepts no liability for any disputes arising from transactions between users.

We reserve the right to remove any listing that violates these terms or that we determine, in our sole discretion, is inappropriate or harmful.

CulchieOS, the CulchieOS logo and all platform content created by Dun na Dev Ltd. are the intellectual property of Dun na Dev Ltd. and are protected by Irish and international intellectual property laws.

You may not use our name, logos or any proprietary content without our prior written permission.

We respect the intellectual property rights of others. If you believe that content on our platform infringes your copyright, please contact us at info@culchieos.com.

To the maximum extent permitted by Irish law, Dun na Dev Ltd. shall not be liable for:

— Any indirect, incidental, special, consequential or punitive damages arising from your use of CulchieOS.

— Any loss of profits, revenue, data, business or goodwill.

— Any errors or inaccuracies in grant scheme information, weather data, or any other third-party data presented within the platform.

Our total liability to you for any claim arising from use of CulchieOS shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

CulchieOS is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not warrant that the platform will be uninterrupted, error-free or free of viruses or other harmful components.

Grant information, weather data and news content are provided for informational purposes only. We make no representation as to the accuracy, completeness or current status of any grant scheme. You should always verify grant eligibility and deadlines directly with the relevant government body.

We may update these Terms of Service from time to time. When we make material changes, we will notify you by email and update the date at the bottom of this page.

Your continued use of CulchieOS after changes take effect constitutes your acceptance of the updated terms.

If you do not agree to the updated terms, you must stop using CulchieOS and may request deletion of your account.
